DESCRIPTION OF SERVICES
Scope of Services:
The Moving Company shall provide the following services as part of the Move:
Loading and Unloading: Loading the Goods onto the moving vehicle and unloading them at the Destination Address.
Transport: Transporting the Goods to the Destination Address in a safe and timely manner.
Assembly and Disassembly: Assembling and disassembling furniture or other items as needed for safe transport.
Packing: Packing will be provided on this job. Packing materials will be provided by the moving company at cost for the customers convenience.
Customer will pay at cost price for materials used after completion of job.
Protection of Goods
The Moving Company shall exercise reasonable care in handling and protecting the Goods during the Move. Any damages to the Goods during transit shall be subject to the terms of Section 5. To prevent damage to goods, please unhook and drain washer/dryers, refrigerators, freezers, (or any other household appliance that holds water) before your movers arrive. Our movers cannot unhook appliances.
Special Disclaimer for PODS Loading
Responders Moving and Storage will pack your POD professionally, as we have done dozens of times. Please do not begin loading your POD before our moving professionals arrive. Responders cannot be responsible for any damage incurred to your belongings during transit- The POD will be handled by PODS representatives in their warehouse using a forklift to stack the PODS, often causing even the best packed PODS to shift internally.
In addition to this variable, in many cases, your POD will be transported on the back of an 18 wheeler by a PODS representative.
Goods that cannot be transported in our truck:
- Anything appearing to be moldy or damp
- Firearms, unless in a locked box
- Propane or any other gas
- Gasoline
- Propane Cylinders
- Paints and Paint Thinners
- Lighter fluid
- Nail Polish Remover
- Fireworks
- Oxygen Bottles
- Automotive Repair and Maintenance Chemicals and Solvents
- Radio-Pharmaceuticals
- Matches
Pet Policy
All pets must be contained in some form before arrival of our crews.
Disclaimer regarding conflicts over personal items in shared living spaces:
In the event of a move due to two people who lived together splitting up, Responders Moving & Storage will not be held responsible for moving items away that may belong to the party not hired by Responders. If an item is moved that belongs to the other party, the responsibility to mitigate the situation will solely be that of the two individuals involved, local law enforcement, etc. Responders team members will follow the directions of whomever is on the contract when deciding which items to load onto the truck.
MOVE DETAILS
Date and Time:
The Parties shall agree on the date and time of the Move, including estimated arrival time at the Destination Address. Any delays due to unforeseen circumstances shall be communicated promptly.
Destination Address:
The Customer shall provide the complete and accurate Destination Address, including any special instructions or requirements for unloading at the Destination Address.
Film Release:
Customer has been informed and has agreed to allow Responders to film, photograph, record and disseminate any and all aspects of this move, including footage taken on private property.
LIABILITY AND INSURANCE
Insurance Claims:
Before leaving the jobsite, Responders team members will do a walk through with the customer to ensure that no items were damaged or misplaced during the move. Any damages must be reported at this time by the customer. In the event of damage or loss, the Customer must file a written claim with the Moving Company within 7 days of the move's completion. The Moving Company shall promptly respond to and process the claim in accordance with its insurance policy and applicable laws.
Proof of Insurance
Upon request, Responders will provide proof of auto liability, general liability, cargo insurance, and workers compensation policies to customer.
Ensuring Items are Not Left Behind
It is Customer's responsibility to make sure that everything they want to be moved is on the truck before truck departs.
Key Exceptions to our Liability
- Responders is only responsible for items in our immediate care, custody, and control. We assume no liability or responsibility for any items and cargo placed in the customer's own vehicle or in rental equipment (not limited to ABF trailers, PODS or any other storage units). Our liability ends once we leave the job site and the liability of damages then falls on the transporter(s).
- Responders is not responsible for items broken by customers on the job.
- Responders is not responsible for damaged items that customers packed themselves, particle board furniture, or lost jewelry.
PAYMENT
Cost of Services:
The Customer agrees to pay the Moving Company the total cost of the Move, which includes all fees for packing, loading, transportation, unloading, and other services as specified in this Contract.
Payment Terms:
Payment shall be made in the following manner:
This moving job will have a 4 hour minimum, charged at the hourly rate quoted on this estimate. If the job takes longer than 4 hours, it will be
billed hourly in 15 minute increments. There is an additional charge of $99 for each item weighing over 150lbs.
Billing will begin when the Responders truck is dispatched from 5 Outlet Road, and will end when the truck and crew return from the jobsite to 5 Outlet Road.
Pads will be folded before leaving the job site. This will be billed time.
Customer may request an additional mover for an additional fee. Responders reserves the right to add an additional mover should there be extremely heavy items that require more than two movers.
Packing will be provided on this job. There is no hourly minimum for packing. Packing materials will be provided by the moving company at cost for the customers convenience. Customer will pay at cost price for materials used after completion of job.
A deposit equal to two times the hourly rate is required to confirm the move.
The balance of the total cost is due on the day of the move, after completion of services. Any disputes regarding the total price of the job must be settled on the day of the job.
Packing will be provided on this job at a rate of $129/hr. This rate will be for one or two packers, depending on availability. Packing materials will be provided by the moving company at cost for the customers convenience. Customer will pay at cost price for materials used after completion of job.
Additional Charges:
The Customer shall be responsible for additional charges resulting from any of the following:
Delays or changes in the Move schedule requested by the Customer.
Additional services requested by the Customer beyond the original scope of the Contract.
Special handling or transportation requirements specified by the Customer.
Unforeseen obstacles or circumstances that affect the Move.
Responders reserves the last 3 feet of truck for our materials. If this forces us to make another trip, the customer will be billed for this time.
CANCELLATION
Cancellation by Customer
If the Customer cancels the Move less than 14 days before the scheduled Move date, the Customer may be subject to a cancellation fee. The cancellation fee is the amount of the deposit.
Cancellation by Moving Company
The Moving Company reserves the right to cancel the Move in the event of unforeseen circumstances, including but not limited to equipment failure, natural disasters, or safety concerns. In such cases, the Moving Company shall make reasonable efforts to reschedule the Move at a mutually agreed-upon time.
Rescheduling Policy
If the Customer requests to reschedule their move with less than 7 calendar days’ notice prior to the scheduled service date, the deposit paid at the time of booking will be forfeited and deemed non-refundable. This policy is in place to compensate for reserved time slots and associated scheduling commitments.
To avoid forfeiture, rescheduling requests must be communicated at least 7 days before the scheduled move date.
CLAIMS AND DISPUTE RESOLUTION
Claims Procedure:
In the event of a dispute or claim arising from the Move, the Parties agree to follow the Moving Company's claims procedure, which shall be provided to the Customer upon request.
Mediation and Arbitration:
Any unresolved disputes or claims shall be subject to mediation and, if necessary, binding arbitration in accordance with the rules of the American Trucking Association (ATA). The Parties agree to participate in good faith in any mediation or arbitration proceedings.
